Matching Law and Name
Updated 2026-08-16
INTRODUCTION
English translation pending.
CORE DEFINITION
The legalist doctrine of matching name and form holds that the minister states what he can deliver, the ruler assigns the task on that basis, and the outcome is checked against the original promise. Falling short is punished, and exceeding the promise is punished too, because diverging from the plan in either direction breaks the alignment on which control rests. It is the extreme ancestor of the modern commitment-based performance contract.
SCAFFOLDING EFFECT
Reduce cognitive load
- Take the promise first: record the commitment before any work starts. - Check the outcome: compare what was delivered with what was promised. - Penalize both directions: treat overshoot as a defect rather than a bonus.
Anchor fast decisions
Control rests on the identity between the stated commitment and the delivered result. When the two match, the ruler can plan; when they diverge in either direction, the basis for planning is broken, which is why exceeding the promise is treated as a defect rather than as a favor.
