CORE DEFINITION
Garden leave, also known as garden leave, refers to a period when an employee who has announced their intention to resign but whose employment contract has not yet been terminated, or when the company intends to terminate the employment relationship for other reasons, is required not to come to work. During this period, the company continues to pay the employee's salary, and both the employee and the company must comply with labor laws, such as the employee still being bound by confidentiality obligations and non-compete clauses. After the formal termination of the employment contract, the company no longer pays the departing employee. Some companies grant garden leave to departing employees because they are concerned that employees intending to leave might steal sensitive company information and join competitors, or that departing employees might deliberately sabotage work out of resentment towards the former company.
